Georgia Law on Speed Limits for Electric Personal Assistive Mobility Devices (O.C.G.A. § 40-6-322)

Legal Commentary . This Georgia statute on electric personal assistive mobility devices provides the speed limits for the devices on sidewalks and roadways. On sidewalks the maximum speed for the device, or electric wheelchair, is 7 m.p.h. Elsewhere, including roadways the device is permitted to be driven on per O.C.G.A. § 40-6-320 is 15 m.p.h. This Georgia law also grants governing authorities to further restrict the speed as they see fit where foot traffic is congested or where foot traffic will be much slower than the devices driven at 7 or 15 maximum miles per hour speed.

Section 40-6-322 Speed limits on sidewalk and elsewhere

No person shall operate an electric personal assistive mobility device at a speed greater than seven miles per hour when traveling on any sidewalk or 15 miles per hour elsewhere; provided, however, that a county or municipal governing authority or the commissioner of transportation may further restrict the speed of such devices in locations where pedestrian traffic is congested and there is a significant speed differential between pedestrians and operators of such devices.
