Premises liability is an area of Georgia law that holds property owners and operators responsible for dangerous conditions on their premises.  If, for example, you slip on spilled barbecue sauce at a grocery store or restaurant, premises liability law might hold the store or restaurant legally responsible for your injuries., depending on the circumstances.  Other common situations that might give rise to a premises liability claim include:

  • Icy or wet walkways or stairs (including public sidewalks around private property);
  • Lack of railings or handrails in high places;
  • Holes, cords and other hazards related to construction work;
  • Attacks by dogs and other domestic animals;
  • Exposure to toxic or dangerous materials;
  • An "attractive nuisance," such as an old refrigerator left outside;
  • Falling objects;
  • Negligent Security at an apartment complex or hotel.

Premises liability does not apply just to stores -- it can also be used in accidents at other businesses, in private homes and on government properties like parks and libraries.  In order to file a successful premises liability claim, you must be able to show that the property's owner knew or should have known about the danger, had time to fix the problem or warn visitors, but did not.  You must also show that you were taking reasonable care for your own safety.  Premises liability law applies only to invited guests and visitors, including customers at a store; trespassers are generally not protected.

Unlawful conditions on the property of another can cause serious injuries, including:

Negligent security is a special type of premises liability law holding property owners responsible when they fail to take adequate security measures to prevent violent crime.  This could apply to landlords, hotel owners and other residential property managers as well as businesses, as long as they are in an area, or have a type of business, that can reasonably be expected to attract crime.  Depending on the circumstances, this could be as trivial as replacing broken locks or as drastic as hiring a private security firm.   For example, an apartment building in a neighborhood that has recently seen a series of break-ins should ensure its locks and intercom system are working, or it may be liable in a Georgia negligent security lawsuit.

When property owners fail to correct serious and clear hazards, they are legally responsible for any injuries that result (including injuries from criminal assaults). Victims have the right to sue those property owners for compensation for their injuries as well as medical bills, lost wages from missed work and pain and suffering.
